Is a bike a safe way to get home from a bar or party?

On Behalf of | Sep 12, 2025 | Criminal Defense |

People who regularly enjoy alcohol are often aware that they are vulnerable to operating while intoxicated (OWI) prosecution. If police officers notice them driving in an impaired state or if they fail a breath test during a traffic stop, then OWI charges are likely.

It can be expensive and inconvenient to rely on services, such as taxis, public transportation and rideshare apps. Other drivers who promise to stay sober may not always keep that promise. People who regularly drink may look for convenient and cost-effective solutions that allow them to enjoy alcohol without putting themselves at legal risk.

Some people turn to bicycles to get around when they intend to drink. People might assume that they can bike to the bar and then back home again after indulging. However, their choice does not necessarily protect them from injury risk or from prosecution.

Bicycles are technically vehicles

Many people forget that bicycles are vehicles. While they do not have an engine, bicycles are human-propelled vehicles that are subject to traffic statutes. Cyclists have to follow most of the same regulations as those operating motor vehicles. That includes the need to remain appropriately sober when on public roads.

Cyclists could be at risk of criminal prosecution if they bike home after drinking enough to fail a chemical test. In fact, the state can even pursue OWI charges against people who ride horses on public roads while drunk or under the influence of drugs.

Police officers who spot wobbly cyclists on the road near large parties or popular bars may pull them over and may even arrest them for an OWI offense. The charges and penalties for drunk bicycle riding are the same as the charges and penalties for drunk driving. An OWI violation can lead to incarceration, fines and a driver’s license suspension even if the person accused was on a bicycle and was not in a motor vehicle at the time of their arrest.

People facing OWI charges may have defense options available to them. Reviewing the details of a recent arrest with a skilled legal team can help those accused of drunk driving or even drunk cycling limit the negativity associated with the aftermath of their arrest.
