Heroin charges are all felonies in Indiana

Many drugs lead to troublesome situations. Heroin is no exception to this. A person who is addicted to heroin is likely going to make some bad choices to get their hands on the drug. There are very serious penalties in the criminal justice system for people who are found guilty of even possession of heroin. The penalties for selling it are more serious.

The possession of heroin is a Class D felony under many circumstances; however, there are times when this it is a more serious charge. Having under three grams within 1,000 feet of school property is a Class B felony, and having more than three grams in this location is a Class A felony. Having more than three grams not near a school is a Class C felony.

Selling heroin in an amount under three grams is a Class B felony. Selling more than that, within 1,000 feet of school property including school buses, or to a minor is a Class A felony.

There is a chance of heading to prison and having to pay a fine when you are convicted on one of these charges. Some individuals might qualify for the drug court program; however, this is a very strict program that has specific criteria for acceptance.
